PRESS RELEASE FOR THE PUBLIC OPINION
The Energy Regulatory Office (ERO) informs the broad public that today, on 09.07.2025, it has received the decisions of the Basic Court in Pristina in two separate cases, which rejected the request for the imposition of a security measure against the Public Notice on the Liberalization of the Electricity Market, published by ERO on 12 March 2025.
The requests for the security measure were submitted by the Democratic Party of Kosovo (PDK), and the Kosovo Chamber of Commerce (OKC) and the Kosovo Producers Association (KPA).
In its reasoning, the Court emphasized that the process of liberalizing the energy market:
- Promotes greater competition among suppliers;
- lower prices and better service for customers;
- Enables suppliers to offer more favourable offers and discounts;
- Increase efficiency in the energy sector, encouraging companies to better manage costs and provide more reliable services, in the interest of customers and the broad public.
The Court also evaluated the evidence submitted by the claimants, including the annual corporate income tax return forms, and found that the businesses in question did not prove that they had fewer than 50 employees, although they had proven an annual turnover of less than 10 million euros. In the absence of meeting both criteria simultaneously, the Court found that ERO acted in accordance with the legislation in force.
ERO recalls that the legal obligations arising from Article 3 point 1.72 and Article 37 of Law No. 05/L-085 on Electricity, which has been in force since 2016 and clearly stipulates that economic enterprises that have more than 50 employees or over 10 million euros in annual turnover are not entitled to universal service of supply, and must be supplied in the free electricity market.
ERO invites all businesses that meet the legal criteria to enter the open market to take the necessary steps to find suppliers to supply them with energy through the free market, taking advantage of the benefits that competition brings.
ERO remains committed to enforcing the law and protecting the public interest, ensuring an open, functional market in line with European standards.
